CUSTOMER TERMS & CONDITIONS AGREEMENT
Effective Date: April 24, 2020
Scope of Services
The Company shall provide the following services:
- Capture a “before” photographic image of each scheduled trash bin and recycling bin prior to service.
- Clean and sanitize the interior surfaces of designated bins.
- Capture an “after” photographic image upon completion of service.
- Provide photographic confirmation to the Client as proof of service completion.
No Re-Service Policy: Once services are rendered and documented, The Bin Men, LLC does not offer refunds, redo services, or makeup appointments.
All invoices must be paid in full prior to the scheduled service date.
These Terms & Conditions (“Agreement”) govern all services provided by The Bin Men (“Company,” “we,” “us,” or “our”) to any customer (“Customer,” “you,” or “your”). By requesting, scheduling, purchasing, subscribing to, or receiving services from The Bin Men, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
These Terms apply to all residential, commercial, HOA, municipal, subscription, recurring, promotional, and one-time cleaning services provided by The Bin Men.
1. ACCEPTANCE OF TERMS
By booking a service appointment, completing an online booking form, approving an estimate, submitting payment, maintaining a subscription, or allowing The Bin Men to perform services at your property, you agree to these Terms & Conditions.
If you are scheduling services on behalf of another person, homeowner association, business, organization, or property owner, you represent that you have authority to accept these Terms on their behalf.
Electronic acceptance, including checking an agreement box online, submitting a booking request, or approving services electronically, shall be considered your legally binding acceptance of this Agreement.
2. SERVICES PROVIDED
The Bin Men provides professional trash and recycling bin cleaning services designed to improve cleanliness, reduce odors, remove waste buildup, and sanitize residential and commercial containers.
Services may include:
- High-pressure cleaning;
- Hot-water cleaning;
- Removal of organic waste and buildup;
- Exterior and interior washing;
- Odor reduction treatments;
- Deodorizing treatments;
- Collection of wastewater generated during cleaning when applicable.
The Bin Men’s service is a professional cleaning service and is not a restoration, repair, replacement, or cosmetic refinishing service. Nor do The Bin Men promise any guarantee to remove every stain or impurity located on the bins that's being serviced.
The goal of service is to provide the cleanest condition reasonably achievable based on the condition of the container at the time of service.
3. SERVICE AREA
The Bin Men provides services within its designated service areas. Service availability, pricing, travel fees, and scheduling may vary depending on location.
The Company reserves the right to modify service areas, routes, availability, and pricing at any time.
Customers outside normal service areas may be subject to additional travel fees, minimum service requirements, or limited scheduling availability.
4. CUSTOMER RESPONSIBILITIES
Customers are responsible for:
- Providing accurate contact information;
- Providing accurate service addresses;
- Ensuring bins belong to the customer or authorized property owner;
- Following preparation instructions before service;
- Providing safe access to the bin;
- Informing The Bin Men of any known hazards or unusual conditions.
The customer must not place the following materials inside bins scheduled for cleaning:
- Hazardous chemicals;
- Medical waste;
- Needles or sharps;
- Explosive materials;
- Flammable liquids;
- Toxic substances;
- Illegal materials;
- Construction materials;
- Concrete, cement, or similar substances.
- Feces of any kind (small poop bags, trash bags containing feces)
The Bin Men reserves the right to refuse service when unsafe conditions exist.
5. BIN PREPARATION REQUIREMENTS
To receive service, customers must:
- Ensure all trash, recycling, or loose debris has been removed before the scheduled cleaning;
- Place bins in an accessible location;
- Ensure lids are closed when possible;
- Ensure gates, vehicles, landscaping, or other objects do not block access.
Customers acknowledge that bins containing remaining garbage, excessive waste, liquids, or prohibited materials may require additional service fees or may be refused.
The Bin Men is not responsible for cleaning contents left inside a bin that prevent proper access to the interior surface.
6. ACCESS TO PROPERTY & SERVICE LOCATION
Customers authorize The Bin Men and its employees, contractors, and representatives to access the designated service area for the purpose of completing scheduled services.
Customers are responsible for ensuring safe access to bins.
The Bin Men is not responsible for delays or inability to complete service caused by:
- Locked gates;
- Blocked driveways;
- Vehicles blocking bins;
- Construction;
- Unsafe conditions;
- Aggressive animals;
- Severe weather;
- Customer failure to prepare bins.
If access to bins is unavailable at the scheduled appointment time, service will be considered as attempted and subject to applicable fees for rescheduling.
7. SCHEDULING & APPOINTMENTS
Service appointments are scheduled based on route availability and operational requirements.
Appointment times may vary due to:
- Weather;
- In some cases, a double-booking system glitch
- Traffic;
- Previous customer appointments that takes longer to service;
- Equipment issues;
- Route changes;
- Other circumstances outside the Company’s control.
The Bin Men will make reasonable efforts to arrive within the scheduled service window but does not guarantee an exact arrival time.
8. CANCELLATIONS & RESCHEDULING
Customers may request cancellation or rescheduling according to the Company’s cancellation policy.
Repeated cancellations, missed appointments, or unavailable bins may result in:
- Additional service fees;
- Removal from recurring routes;
- Suspension of service;
- Cancellation of subscriptions.
The Company reserves the right to establish reasonable cancellation deadlines and fees.
9. WEATHER & UNFORESEEN CONDITIONS
The Bin Men may postpone or reschedule service due to conditions that may affect safety, equipment operation, or cleaning effectiveness.
Examples include:
- Extreme temperatures;
- Lightning;
- Severe storms;
- Unsafe road conditions;
- Equipment failure;
- Municipal restrictions;
- Other circumstances outside the Company’s reasonable control.
Customers will be notified when reasonably possible.
10. SERVICE COMPLETION
Service shall be considered completed when The Bin Men has performed the scheduled cleaning process and returned the bin to its designated location or completed the service process available at the property.
Customers must report service concerns promptly after completion.
Failure to report a legitimate service issue within a reasonable timeframe may limit the Company’s ability to investigate or correct the concern.

11. PRICING & PAYMENT TERMS
All pricing for services provided by The Bin Men is based on current rates, service location, bin quantity, service type, promotions, and any applicable fees.
The Bin Men reserves the right to change pricing, fees, promotions, and service packages at any time. Any pricing changes will not affect services already purchased unless otherwise agreed upon.
Payment is due according to the payment terms provided at the time of booking, subscription enrollment, invoice issuance, or service agreement.
Accepted payment methods may include:
- Credit card;
- Debit card;
- Electronic payment methods;
- At this time we do not take apple pay. If you use this method it will be charged but we will not receive the payment. And there no refunds from this.
- Other approved payment methods offered by The Bin Men.
Customers authorize The Bin Men to charge the selected payment method for approved services, recurring services, applicable fees, and outstanding balances.
12. FAILED PAYMENTS & COLLECTIONS
If payment is declined, reversed, disputed, or otherwise unpaid, The Bin Men enforces the right to:
- Attempt to process payment again;
- Suspend future services;
- Cancel recurring services;
- Apply applicable late fees;
- Pursue collection of unpaid balances.
Customers remain responsible for all unpaid invoices, approved charges, and fees associated with services provided.
Any attempt to improperly reverse payment, including unauthorized chargebacks for properly completed services, will be considered a breach of this Agreement.
The Bin Men reserves the right to provide documentation, photographs, invoices, service records, and communication records to defend against improper payment disputes.
13. RECURRING SERVICES & SUBSCRIPTIONS
Customers enrolling in recurring services authorize The Bin Men to provide scheduled cleaning services in accordance with the selected service plan.
Recurring services may include:
- Monthly cleaning;
- Bi-Monthly cleaning;
- Quarterly cleaning;
- Route-based service schedules.
By enrolling in recurring service, customers authorize recurring billing using the payment method provided during enrollment.
Customers may cancel recurring services by contacting The Bin Men according to the cancellation requirements provided with their service plan.
Cancellation does not remove responsibility for:
- Completed services;
- Outstanding invoices;
- Services already scheduled;
- Charges incurred before cancellation becomes effective.
14. PROMOTIONAL PRICING & DISCOUNTS
Promotional pricing, discounts, referral credits, introductory offers, and special pricing are subject to the terms stated at the time of promotion.
Promotions may include restrictions such as:
- Limited availability;
- Service area limitations;
- Expiration dates;
- Minimum quantities;
- Subscription requirements.
The Bin Men reserves the right to modify, suspend, or discontinue promotions at any time.
Promotional discounts cannot be combined.
15. REFUND POLICY
Due to the nature of providing a scheduled service, there are no refunds.
If The Bin Men is unable to perform service due to circumstances caused by the Company, a reasonable resolution may be provided at the Company’s discretion.
16. CLEANING RESULTS & SERVICE LIMITATIONS
The Bin Men provides professional cleaning and sanitization services. However, customers acknowledge that cleaning results vary depending on:
- Age of the bin;
- Previous use;
- Exposure to weather;
- Waste materials previously stored;
- Condition of the plastic;
- Existing damage;
- Type of contamination.
The Bin Men does not provide restoration, repainting, resurfacing, or replacement services.
A bin may be professionally cleaned while still showing permanent cosmetic imperfections.
17. PERMANENT STAINS, DISCOLORATION, ADHESIVES & STICKY RESIDUE
The Bin Men makes reasonable professional efforts to remove dirt, grime, organic waste, and removable buildup.
However, The Bin Men does not guarantee removal of permanent or bonded materials, including:
- Black stains;
- Dark streaks;
- Permanent discoloration;
- Mold or mildew staining;
- Grease and oil stains;
- Chemical discoloration;
- Rust staining;
- UV-related fading;
- Oxidation;
- Adhesive residue;
- Stickers and labels;
- Tape residue;
- Glue;
- Tar;
- Paint;
- Tree sap;
- Hardened grease;
- Hardened food waste;
- Other substances bonded to the plastic surface.
The Bin Men will not use methods that may damage the container, including excessive scraping, sanding, aggressive chemicals, or processes that may weaken the plastic.
The continued presence of stains, residue, or discoloration after cleaning does not indicate that the service was incomplete.
18. GREEN & YELLOW COUNTY-ISSUED BIN DISCLAIMER
Customers acknowledge that green, yellow, and other brightly colored trash and recycling bins may display staining, discoloration, fading, or cosmetic imperfections more visibly after cleaning.
County-issued and municipal containers may have years of:
- Outdoor exposure;
- Weather damage;
- UV exposure;
- Waste contact;
- Chemical exposure;
- Normal wear and tear.
The Bin Men does not guarantee that green or yellow containers will return to a like-new appearance.
The purpose of cleaning is to improve sanitation, cleanliness, and odor conditions—not restore the container to a new condition.
19. ODORS, MAGGOTS & ORGANIC CONTAMINATION
The Bin Men’s cleaning process is designed to remove waste buildup, organic residue, insects, and odor-causing materials.
However, extremely contaminated bins may require additional cleanings to achieve the desired level of odor control.
The Bin Men does not guarantee complete elimination of odors caused by:
- Deeply absorbed contamination;
- Long-term waste exposure;
- Chemical reactions;
- Permanent plastic absorption;
- Previous improper storage.
Customers acknowledge that severe contamination may require repeated service.
20. PRE-EXISTING DAMAGE & BIN CONDITION
The Bin Men is not responsible for damage, defects, or conditions existing before service.
This includes:
- Cracks;
- Broken lids;
- Damaged wheels;
- Missing parts;
- Weak plastic;
- Warping;
- Fading;
- Scratches;
- Gouges;
- Manufacturer defects;
- Previous chemical damage;
- Structural deterioration.
Customers acknowledge that cleaning may reveal existing conditions that were previously hidden by dirt, grime, or buildup.
The Bin Men is not responsible for normal wear and tear or deterioration of customer-owned or third-party-owned containers.

21. WASTEWATER COLLECTION & ENVIRONMENTAL PRACTICES
The Bin Men is committed to responsible cleaning practices and uses professional methods designed to minimize environmental impact.
During the cleaning process, wastewater, debris, and contaminants are removed from bins are collected.
Customers acknowledge that trash and recycling bins may contain bacteria, organic waste, chemicals, oils, and other contaminants accumulated through normal use.
The Bin Men is not responsible for contamination, spills, leaks, or environmental conditions caused by waste, liquids, or substances placed inside the customer's container before service.
Customers must disclose any known hazardous materials or unusual contamination before service.
22. PHOTOGRAPHS, VIDEO & SERVICE DOCUMENTATION
The Bin Men document service activities through photographs, route records, invoices, and other service documentation.
Documentation may be used for:
- Confirming service completion;
- Quality assurance;
- Customer service review;
- Resolving disputes;
- Training purposes;
- Business records.
The Bin Men may use photographs or videos for marketing purposes only when reasonable efforts are made to remove or avoid personally identifying information, including addresses, personal property details, or customer information.
Customers may request that identifiable images of their property not be used for marketing purposes by contacting The Bin Men.
23. CUSTOMER PROPERTY & DAMAGE CLAIMS
Customers must report any claim of damage, loss, or service-related concern promptly after service.
Claims must include:
- Customer name;
- Service address;
- Date of service;
- Description of the alleged issue;
- Supporting photographs when available.
The Bin Men will review legitimate claims in good faith.
The Bin Men is not responsible for:
- Pre-existing damage;
- Normal wear and tear;
- Manufacturer defects;
- Damage caused by improper use;
- Damage caused by unsafe bin conditions;
- Conditions unrelated to the cleaning service.
Failure to report a claim within a reasonable timeframe may affect the Company's ability to investigate.
24. RIGHT TO REFUSE OR DISCONTINUE SERVICE
The Bin Men reserves the right to refuse, suspend, or discontinue service when conditions create safety, legal, operational, or equipment concerns.
Examples include:
- Hazardous materials;
- Illegal substances;
- Unsafe property conditions;
- Threatening or abusive behavior;
- Aggressive animals;
- Repeated missed appointments;
- Non-payment;
- Customer violations of these Terms.
The Bin Men is not required to provide service when doing so could create a risk to employees, contractors, equipment, customers, property, or the public.
25. LIMITATION OF LIABILITY
To the fullest extent permitted by law, The Bin Men shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of services.
The Bin Men’s total liability for any claim related to services shall not exceed the amount paid by the customer for the specific service giving rise to the claim.
The Bin Men is not responsible for:
- Loss of use;
- Lost profits;
- Business interruption;
- Replacement costs;
- Cosmetic imperfections;
- Conditions outside reasonable control.
This limitation does not apply where prohibited by applicable law.
26. CUSTOMER INDEMNIFICATION
Customer agrees to defend, indemnify, and hold harmless The Bin Men, its owners, employees, contractors, and representatives from claims, damages, liabilities, losses, or expenses arising from:
- Customer-provided information;
- Customer misuse of services;
- Hazardous materials placed in bins;
- Unsafe property conditions;
- Violation of these Terms;
- Unauthorized claims or actions related to customer-owned conditions.
27. FORCE MAJEURE
The Bin Men shall not be responsible for delays, interruptions, or failure to perform services caused by events beyond reasonable control.
Examples include:
- Severe weather;
- Natural disasters;
- Government restrictions;
- Road closures;
- Equipment failure;
- Labor shortages;
- Supply shortages;
- Utility failures;
- Emergencies;
- Other unforeseen circumstances.
The Bin Men will make reasonable efforts to resume service when conditions allow.
28. COMMUNICATIONS & CUSTOMER CONTACT
By providing contact information, customers authorize The Bin Men to communicate regarding:
- Appointment reminders;
- Service updates;
- Billing;
- Account information;
- Promotions;
- Customer service matters.
Communications may occur through:
- Phone calls;
- Text messages;
- Email;
- Online platforms.
Customers may request removal from promotional communications at any time.
Service-related communications may continue while an active customer relationship exists.
29. PRIVACY
The Bin Men respects customer privacy and uses customer information for legitimate business purposes, including:
- Scheduling;
- Billing;
- Customer support;
- Service improvements;
- Business operations.
Customer information will not be sold for unrelated purposes.
The Bin Men may maintain records necessary for accounting, legal compliance, dispute resolution, and business operations.
30. GOVERNING LAW
This Agreement shall be governed by and interpreted according to the laws of the State of Maryland, without regard to conflict-of-law principles.
Any dispute arising from these Terms or services provided by The Bin Men shall be handled according to applicable Maryland law.
31. DISPUTE RESOLUTION
Before initiating legal action, customers agree to first contact The Bin Men and provide an opportunity to review and resolve the concern.
If a dispute cannot be resolved informally, either party may pursue available legal remedies in the appropriate jurisdiction.
Nothing in this Agreement prevents either party from seeking lawful remedies available under applicable law.
32. ATTORNEYS' FEES & COLLECTION COSTS
If The Bin Men must take action to collect unpaid balances, enforce these Terms, or defend against improper claims, the Company may seek recovery of reasonable costs and expenses where permitted by law.
Such costs may include:
- Collection expenses;
- Filing fees;
- Legal expenses;
- Reasonable attorneys' fees.
33. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
34. CHANGES TO TERMS
The Bin Men reserves the right to update or modify these Terms & Conditions at any time.
Updated Terms will apply to future services and transactions after the effective date of the revision.
Customers are encouraged to review the current Terms & Conditions before purchasing services.
35. ENTIRE AGREEMENT
These Terms & Conditions, together with any applicable estimates, invoices, service agreements, subscription agreements, or written policies provided by The Bin Men, represent the complete agreement between The Bin Men and the customer regarding services.
Any previous discussions, representations, or understandings not included within this Agreement are replaced by these Terms.
CUSTOMER ACKNOWLEDGEMENT
By scheduling, purchasing, or receiving services from The Bin Men, the customer acknowledges:
✓ They have reviewed and accepted these Terms & Conditions.
✓ They understand cleaning results vary based on bin condition.
✓ They understand permanent stains, discoloration, adhesives, and residue may remain.
✓ They understand The Bin Men provides cleaning services and does not guarantee cosmetic restoration.
✓ They agree to fulfill payment obligations for services provided.
